For the purpose of providing our Website and Service directly to you (our customer), Uplane acts as a Data Controller over certain personal data we collect from you (e.g., your account details, billing information).

When our customers use the Uplane Service to process personal data of their end-users (e.g., collecting lead data on landing pages, tracking ad performance for campaigns), Uplane typically acts as a Data Processor on behalf of our customers. In such cases, our customers are the Data Controllers and are responsible for ensuring they have the necessary legal bases and notices in place. We have separate Data Processing Agreements (DPAs) with our customers to govern these processing activities.

We collect various types of information from and about you to provide and improve our Website and Service.

a. Information You Voluntarily Provide to Us:
When you register for an account, subscribe to our Service, contact support, or interact with our Website, you may provide us with the following personal data:

  • Payment & Billing Information: Credit card numbers, billing address, bank account details (collected and processed by our third-party payment processors; we typically do not store full payment card details ourselves).

  • Profile Information: Your job title, industry, and other professional details provided to customize your Uplane experience.

  • Communications: Records of your correspondence with us, including customer support inquiries, feedback, survey responses, and interactions on social media.

  • User-Generated Content: Any information, text, images, or other content you upload, create, or manage through the Uplane Service (e.g., ad copy, landing page content, campaign settings).

To Provide and Maintain Our Service:

  • To register and manage your Uplane account.

  • To process your subscriptions, payments, and deliver the features of our marketing management platform.

  • To enable ad generation, landing page creation, ad cost tracking, and other functionalities you utilize.

  • To provide technical support and respond to your inquiries.

To Improve and Personalize Your Experience:

  • To analyze how you use our Website and Service to identify areas for improvement.

  • For Business Transfers: In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.

  • With Affiliates: We may share your information with our current or future affiliates, in which case we will require those affiliates to honor this Privacy Policy.

  • For Legal Reasons: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation (e.g., court order, subpoena), (ii) protect and defend our rights or property, (iii) prevent or investigate possible wrongdoing in connection with the Service, (iv) protect the personal safety of users of the Service or the public, or (v) protect against legal liability.

In the preceding twelve (12) months, Uplane has not sold personal information.
We may share the following categories of personal information for cross-context behavioral advertising with third parties:

  • Identifiers (e.g., IP address, online identifiers)

  • Internet or other similar network activity

We share this information with the following categories of third parties:

  • Advertising Networks

We do not knowingly sell or share the personal information of consumers under 16 years of age.

B.5) Your California Privacy Rights

Subject to certain exceptions, California consumers have the following rights regarding their personal information:

  • Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to limit our use and disclosure of your sensitive personal information to that which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services. As we primarily collect sensitive personal information for payment processing, such use is generally considered necessary for the service. If we process other sensitive personal information in a way that allows for this right, we will provide a specific mechanism.

  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

B.6) Exercising Your California Privacy Rights

To exercise the rights described above, please submit a verifiable consumer request to us by either:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

Your request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative (e.g., confirming your email address associated with your Uplane account).

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will endeavor to respond to your request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.
